Grand Theft

There are many different kinds of theft. The most common are shoplifting and petit theft, both of which are considered relatively minor offenses. But when the value of a stolen item is more than $300, a defendant may be charged with grand theft. The crime is a felony and carries with it serious criminal and administrative charges.

Just like homicide, there are three different degrees of grand theft that can be committed in Florida. The first is by far the most serious charge. A defendant may be charged with grand theft of the first degree if he is accused of stealing property that is valued at over $100,000 or shipping cargo that is worth more than $50,000. If convicted, a person will face a minimum of 21 months and a maximum of 30 years in prison. He may also be subject to thirty years of probation and a fine of up to $10,000.

When accused of stealing property that is worth less than $100,000, but more than $20,000, the defendant may be charged with grand theft of the second degree. A conviction for this crime may result in 15 years in prison, fifteen years of probation, a fine up to $10,000, or any combination of the three.

Grand theft of the third degree is a charge that is entered when a person is accused of stealing property that is worth less than $20,000, but more than $300. If convicted, a person may be sentenced to 5 years in prison, 5 years of probation, a fine of up to $5,000, or any combination of the three.
